CARY, N.C. (Sept. 9, 2009) – Rebecca L. Stevens, managing partner of Stevens & Hand PLLC, offers
legal insight for North Carolina real estate brokers, buyers and sellers who are frequently
facing the implications of the increasing requirement for long form lien waivers.
A long form lien waiver is the affidavit and agreement signed by any person, firm or
corporation that has provided a service or goods that improved the real property being
transferred. These services include, but are not limited to, plumbing, electrical, flooring,
tile, roof, concrete, lumber and landscape. In the case of new construction, this means
that the owner of the property, the general contractor and all sub-contractors must sign
that they have been paid and will not file a “claim of lien” against the property. At times,
this can require in excess of 30 people and can cause unexpected additional delays for
closings.
The need for long form lien waivers, particularly for new construction, has increased with
the nation’s rapidly changing economic state. In response, Stevens & Hand, PLLC is
providing educational sessions to assist listing and selling agents as they prepare and
work to avoid problems, such as closing delays, which can arise as a result of incomplete
lien waiver documents.
